International Family Law

Denver International Family Law Attorneys

Experienced Legal Counsel for Cross-Border Family Disputes

When family law matters involve international elements, whether a spouse is a foreign national, children have been taken across borders, or assets are located in multiple countries, the complexity increases exponentially. These cases require attorneys who understand not only Colorado family law but also international treaties, foreign legal systems, and the procedural challenges of cross-border disputes. At Frost & Beck, PC, our Denver international family law attorneys bring specialized expertise to these challenging cases.

Our firm's unique qualifications distinguish us in this specialized field. Both founding partners hold graduate degrees in diplomatic studies, providing deep understanding of international relations and cross-cultural legal issues. Christelle C. Beck has served as an Adjunct Professor of International Law at the University of Denver Sturm College of Law. Most significantly, our firm maintains referral status with the U.S. Department of State to represent left-behind parents in international child abduction cases, a credential held by only a select number of attorneys nationwide.

International Child Abduction Under The Hague Convention

International child abduction, when a parent takes or retains a child in another country without the other parent's consent, represents one of the most urgent and emotionally devastating family law situations. The Hague Convention on the Civil Aspects of International Child Abduction provides a legal framework for the prompt return of wrongfully removed or retained children to their country of habitual residence.

Key Aspects of Hague Convention Cases:

  • Purpose: The Convention does not determine custody, it establishes procedures for returning children to their home country where custody disputes should be resolved.
  • Scope: The Convention applies to children under 16 who were habitually resident in a signatory country immediately before the wrongful removal or retention.
  • Time Sensitivity: Hague cases are expedited proceedings. Courts must act promptly, and delays can affect case outcomes. When a child has been in the new country for more than one year, additional defenses become available.
  • Defenses: Limited defenses exist, including consent or acquiescence by the other parent, grave risk of harm to the child if returned, and violation of fundamental human rights principles.
  • Jurisdiction: In the United States, Hague Convention cases proceed in federal court under the International Child Abduction Remedies Act (ICARA).

We represent both left-behind parents seeking the return of abducted children and parents defending against return petitions when legitimate defenses exist. Our experience in both federal and state courts, combined with our understanding of international legal frameworks, positions us to handle these high-stakes cases effectively.

International Child Custody Disputes

When parents live in different countries and disagree about where children should reside or how custody should be allocated, international custody disputes arise outside the Hague abduction context. These cases involve complex jurisdictional questions, competing legal systems, and practical challenges in enforcement.

Our attorneys handle cases involving:

  • Establishing initial custody when parents reside in different countries
  • Enforcing U.S. custody orders abroad or foreign custody orders in Colorado
  • Modifying custody arrangements when international relocation is proposed
  • Addressing jurisdictional conflicts under the Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA)
  • Preventing international removal when flight risk exists
