International Child Abduction Under The Hague Convention

International child abduction, when a parent takes or retains a child in another country without the other parent's consent, represents one of the most urgent and emotionally devastating family law situations. The Hague Convention on the Civil Aspects of International Child Abduction provides a legal framework for the prompt return of wrongfully removed or retained children to their country of habitual residence.

Key Aspects of Hague Convention Cases:

  • Purpose: The Convention does not determine custody, it establishes procedures for returning children to their home country where custody disputes should be resolved.
  • Scope: The Convention applies to children under 16 who were habitually resident in a signatory country immediately before the wrongful removal or retention.
  • Time Sensitivity: Hague cases are expedited proceedings. Courts must act promptly, and delays can affect case outcomes. When a child has been in the new country for more than one year, additional defenses become available.
  • Defenses: Limited defenses exist, including consent or acquiescence by the other parent, grave risk of harm to the child if returned, and violation of fundamental human rights principles.
  • Jurisdiction: In the United States, Hague Convention cases proceed in federal court under the International Child Abduction Remedies Act (ICARA).
