What a Revocable Living Trust Does (and Doesn’t Do)

A revocable living trust is a legal arrangement in which you transfer assets into the trust, name a trustee to manage them, and designate beneficiaries to receive them. During your lifetime, you typically serve as both the person who created the trust and the trustee, so you retain full control. You can add assets, change beneficiaries, amend the terms, or revoke the trust entirely at any point.

For Colorado families, the primary reasons to create a revocable living trust are probate avoidance and privacy.

Probate Avoidance

Assets held in a properly funded revocable living trust can transfer directly to beneficiaries without going through the Colorado probate process. Colorado probate typically takes nine months to two years or more and involves court fees, attorney fees, and personal representative fees. Avoiding it is often the main goal.

Privacy

A will becomes public record when it’s admitted to probate. A revocable living trust doesn’t. The distribution of your assets and the identity of your beneficiaries remain private.

Incapacity Planning

If you become incapacitated, a named successor trustee steps in to manage trust assets without requiring a court-supervised conservatorship. This is one of the less-discussed but genuinely practical advantages of trust planning.

What a Revocable Living Trust Doesn’t Do

A revocable trust doesn’t shield assets from creditors, lawsuits, or nursing home costs. Because you retain control, the assets remain part of your taxable estate and are still counted as available resources for Medicaid eligibility purposes. Colorado has no state estate tax, and federal estate tax applies only to larger estates, so most families here use a revocable living trust for probate avoidance and privacy rather than tax reduction.

Revocable vs. Irrevocable Trusts

The core distinction is control. A revocable trust lets you retain ownership and make changes at any time. An irrevocable trust generally can’t be modified or revoked once established. When you transfer assets into an irrevocable trust, you give up ownership of those assets, which can reduce estate tax exposure and may offer creditor protection depending on the structure.

Which type is appropriate depends entirely on your goals. Probate avoidance and flexibility point toward a revocable structure. Asset protection and tax planning may call for an irrevocable arrangement. These aren’t interchangeable tools, and the right choice requires looking at your specific financial picture and family situation.

Common Mistakes That Undermine a Revocable Trust

The most frequent reason a revocable living trust fails to avoid probate is straightforward: the grantor created the document but never transferred assets into it. The document alone does nothing without funding.

Assets commonly transferred into a revocable trust:

• Bank and brokerage accounts
• Non-retirement investment accounts

Assets generally not transferred into a revocable trust:

• IRAs and 401(k)s (transferring ownership of these accounts triggers significant tax consequences)
• Life insurance policies (though the trust can be named as beneficiary)

Beneficiary designations on retirement accounts, life insurance, and payable-on-death accounts operate independently of your trust document and override what the trust says. Coordinating these designations is a necessary part of a complete plan, not an afterthought.

Generic or template trust documents that don’t account for Colorado law or your family’s specific circumstances can create gaps that lead to disputes or unintended outcomes. A trust should also be reviewed after major life events: marriage, divorce, the death of a named trustee or beneficiary, or significant changes in assets.
