Denver Adoption Attorney
Guiding You Through the Legal Process of Building Your Family
Adoption is one of the most profound ways to build or expand a family. Whether you are a stepparent seeking to formalize your relationship with a child you have helped raise, a relative providing a permanent home for a family member's child, or navigating a more complex adoption situation, the legal process requires careful attention to Colorado's statutory requirements. At Frost & Beck, PC, our Denver adoption attorneys are dedicated to helping you complete your adoption as smoothly and efficiently as possible while ensuring full compliance with all legal requirements.
Adoption creates a legal parent-child relationship identical to biological parentage. Once finalized, an adoption is permanent, and the adopted child has all the same rights as a biological child, including inheritance rights and the right to parental support. Because of this permanence, Colorado law imposes specific procedural safeguards to protect everyone involved: the child, the adoptive parents, and when applicable, the biological parents.

Types of Adoption We Handle
Our Denver adoption attorneys assist clients with all types of adoption matters recognized under Colorado law:
Stepparent Adoption
Stepparent adoption is one of the most common adoption types. When a stepparent has developed a parental relationship with their spouse's child and wishes to formalize that bond, adoption creates a permanent legal relationship. Stepparent adoptions require either the consent of both biological parents or, if consent is not given, a court determination that the non-consenting parent's rights should be terminated. Grounds for involuntary termination include abandonment, failure to support, and other statutory criteria.
Kinship (Relative) Adoption
When grandparents, aunts, uncles, or other relatives assume permanent responsibility for a child, kinship adoption provides legal recognition of that relationship. These adoptions often arise when biological parents cannot care for their children due to substance abuse, incarceration, mental health issues, or death. Kinship adoptions may follow foster care placement or occur through direct arrangements with biological parents.
Legal Custodian Adoption
Individuals who have been appointed as a child's legal custodian may petition to adopt the child after establishing a stable, beneficial relationship. This pathway recognizes that legal custodians often function as de facto parents and formalizes those relationships permanently.
Custody Adoption
In some situations, individuals who have physical custody of a child but lack formal legal status may petition for adoption to establish their parental rights. These cases often involve complex factual histories and require careful navigation of consent and termination requirements.
Adult Adoption
Colorado allows adults to be adopted, creating a legal parent-child relationship regardless of the adoptee's age. Adult adoption is commonly used to formalize long-standing family relationships, facilitate estate planning, or recognize chosen family bonds. The process is simpler than child adoption since consent issues typically do not arise, the adult adoptee consents to their own adoption.
The Colorado Adoption Process
While specific requirements vary by adoption type, most adoptions follow these general steps:
- Eligibility Verification: Colorado requires adopting parents to be at least 21 years old. Married couples must petition jointly (with limited exceptions for stepparent adoptions). We verify that you meet all statutory requirements before proceeding.
- Home Study (When Required): Many adoption types require a home study conducted by a licensed agency. The home study evaluates the prospective adoptive home's suitability, including background checks, home visits, interviews, and reference verification.
- Consent and/or Termination: Biological parents' rights must be addressed through either voluntary consent to the adoption or involuntary termination of parental rights.
- Filing the Petition: We prepare and file a formal adoption petition with the court, including all required supporting documentation, sworn statements, and reports.
- Court Review and Hearing: The court reviews the petition and supporting materials to ensure all legal requirements are met. A hearing is typically held where the judge confirms that the adoption serves the child's best interests.
- Final Decree: Upon approval, the court issues a final decree of adoption, establishing the legal parent-child relationship. A new birth certificate can then be issued reflecting the adoptive parents.
