Our mediators aim to help couples resolve their divorce issues

Some couples in the Denver area may want to divorce, but they may be concerned about the costs that a lengthy litigation process would bring. They may be pleased to hear then, that there are alternatives to litigating a divorce that can save money, time and perhaps even heartache. One of these options is divorce mediation. In fact, most judicial districts in Colorado mandate that spouses seeking a divorce first try mediation before they are allowed to go through the litigation process.

A mediator is a neutral third party who helps the spouses with negotiating a resolution to their divorce legal issues. The hope is that, by working together through mediation, the final result will be satisfactory to each spouse. Moreover, whatever the spouses talk about in the mediation process will remain confidential, so even if mediation fails, the conversations therein cannot be used against a spouse. This may make spouses more apt to be open and honest in what their needs and wants are.

In addition, because the parties are ultimately in control of the outcome of the mediation process, it is possible to be creative in reaching a resolution. Resolutions created through mediation can also be more detailed and more in line of each spouse's needs. In addition, since any agreements made during mediation are voluntary, spouses may feel better about the outcome of their divorce, as opposed to being pitted against their spouse in litigation where there is one "winner" only.

A mediator cannot give spouses legal advice. Instead, they work to help the spouses have conversations that are focused and constructive. Through the structured and confidential setting that mediation provides, it is hoped that the spouses will experience less conflict than they would experience if they tried to negotiate their divorce on their own.

Of course, there are some situations in which mediation would not be appropriate, such as in cases of domestic abuse. Mediation can save time, money and stress, making it an attractive option to many couples seeking a divorce.
